On February 16, 2017, I appeared in the Vicinage 2 Municipal Court on behalf of my client who was charged with Possession of Marijuana under 2C:10-A(4) in Teaneck.
I previously asked the judge to set a deadline pursuant to State v. Holup for the State to produce complete discovery. As of this deadline, the State still did not produce the missing discovery. Therefore, the judge dismissed my client’s case.
I handle many drug cases and missing discovery is a frequent problem. The Holup case allows judges to set a deadline for the State to produce all of your discovery. This can be useful, if applicable to your case, and may save you a conviction on your record.
