Expungement Granted for Mahwah and East Rutherford Cases

My client was arrested in Mahwah for possession of less than 50 grams of marijuana under N.J.S.A. 2C:35-10A(4) and possession of drug paraphernalia under N.J.S.A. 2C:36-2. He was subsequently convicted of the possession of drug paraphernalia charge. The possession of marijuana charge was dismissed.

He was also arrested in East Rutherford for theft by deception under N.J.S.A. 2C:20-3A. This charge was dismissed. Instead, he was found guilty of a violation of public peace and good order under East Rutherford Ordinance § 214.2.

Even when charges are dismissed, the arrests can still appear on a criminal background check. Therefore, in order to clear the arrests and convictions from the client’s criminal record, it was necessary to file for an expungement in the Bergen County Superior Court.
