In April, I petitioned for an expungement on behalf of a client who had an arrest on her record from 2014.
She was arrested for Aggravated Assault under NJSA 2C:12-1B(5)(A), Obstructing under NJSA 2C:29-1A, Resisting Arrest under NJSA 2C:29-2A(1), and Improper Behavior under NJSA 2C:33-2A(1).
Despite the fact that her charges were ultimately dismissed in the North Arlington Municipal Court, the arrest for these charges still remained on her record. She was even turned down for a job because the arrest came up on her background check.
However, the Bergen County Superior Court granted the petition and therefore the record of her arrest will be expunged from her background check.
If you have been arrested but the case was dismissed, you could still have an issue when applying for a new job due to the fact that arrest can still appear on your record.
