New Amendments to the Expungement Statute

On April 18, 2016, the new amendments to New Jersey’s expungement statute went into effect.

Two of the most notable changes are as follows:

NJSA 2C:52-2(a) now allows for the expungement of one indictable offense and up to two disorderly persons offenses.

NJSA 2C:52-3(b)(2) reduces the waiting period to expunge a disorderly persons offense from five years to three if the petitioner can show that the expungement is in the public interest.
