On December 3, 2015, I appeared in the Manville Municipal Court. My client was issued a ticket for an improper turn (39:4-123) as a result of an accident. A violation of 39:4-123 carries 3 motor vehicle points. I successfully negotiated a plea bargain of Unsafe Operation (39:4-97.2) in order to downgrade the points to zero. I also obtained a civil reservation for my client which prevents the use of his guilty plea in a civil proceeding. In other words, if the other person involved in the accident files a civil lawsuit against my client, the fact that my client pled guilty to a plea bargain cannot be used against him in the civil case.
If you have been charged with a motor vehicle violation as a result of an accident, it is important to speak with an attorney about your rights. Depending on the facts and circumstances of your case, your attorney can request that the court grant a civil reservation.
