On June 27, 2017, the Appellate Division of New Jersey reversed a DWI conviction on speedy trial grounds due to an excessive delay in the case. In State v. Petruzziello, Docket No. A-2462-15T1 (June 27, 2017), the defendant’s case was initially sent to the Morris County Prosecutor’s Office, but was later remanded down to the Rockaway Municipal Court.
The Appellate Division found that there was a twenty-two month delay in the case and the delay was attributable to the prosecution. Therefore, the Appellate Division reversed the defendant’s conviction.
